Those who have changed from Family Residence Permit to Short Term Residence Permit

Family residence permit, Foreigners and International Protection Law No. 34 of 6458 and is regulated under Article 37 of the Turkish citizens or foreigners with residence permits granted to family members of a residence permit in Turkey.

In the event of the divorce of foreigners who are married to a Turkish citizen or the death of their sponsor, a short-term residence permit can be changed from family residence permit.

In Which Situations Can a Short Term Residence Permit be Used?

1. In cases where a foreigner residing with a family residence permit divorces from his Turkish spouse;

In order for a foreigner residing with a family residence permit to switch to a short-term residence permit after divorce from his Turkish spouse, the marriage must have lasted for at least 3 years. However, in cases where the foreign spouse is a victim of domestic violence, it is not required that the marriage lasted for 3 years. The important thing here is that the foreign national person adds the court decision regarding this to the file.

2. In cases where the sponsor dies;

In case of death, the sponsor can switch from family residence permit to short-term residence permit by presenting the foreigner death certificate. If the death certificate is received from the Turkish authorities, it must be e-signed / signed and stamped / stamped, and the death certificates obtained from abroad must be notarized and Apostille annotation in Turkish.

Documents Required for Foreigners Transferring to Short Term Residence Permit from Family Residence Permit

1. Residence Permit Application Form;

2. The original or photocopy of the passport or a valid substitute document;

3. Statement of sufficient and regular financial means during the stay (Administration may request supporting documents);

4. Valid Health Insurance;

5. Divorce or death certificate;

6. Original family residence permit card.

Important notes:

In the case of transfer from family residence permit to short-term residence permit due to divorce, if a Turkish citizen is divorced after 3 years or more, a court decision regarding divorce is requested. In the event that a foreign national divorces a Turkish citizen due to domestic violence in less than 3 years, a court decision revealing the domestic violence is requested.

Death certificate is required for the transfer applications made from family residence permit to short-term residence permit due to the death of the sponsor. Death certificates obtained from Turkish authorities must be e-signed / signed and stamped / stamped, death certificates obtained from abroad must be notarized and an Apostille translated into Turkish. In the event that the citizens of the countries not party to the Apostille Agreement die, the death certificate must be approved by the Ministry of Foreign Affairs or the consulate of the state that issued the death certificate.

Foreigners who will change from family residence permit to short-term residence permit must present the original family residence permit.
